These Terms of Use ("Terms") govern your access to and use of Bormacc's public website(s) (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

To the maximum extent permitted by law, Bormacc's total liability for any claim arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Bormacc from and against claims, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any rights of another.
Governing law; venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Unless prohibited by law, you agree that any dispute not subject to arbitration (if arbitration is adopted below) will be brought in the state or federal courts located in Texas, and you consent to personal jurisdiction there.
Optional: arbitration and class action waiver (if adopted)
Except where prohibited by law, you and Bormacc agree that any dispute arising out of or relating to the Site or these Terms will be resolved by binding arbitration on an individual basis and not in a class, consolidated, or representative action. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary. You understand that, absent this provision, you might have had a right to litigate in court and to have a jury trial. This section applies only if Bormacc elects to adopt arbitration for the Site.
Severability; entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Bormacc regarding your use of the Site.
